New Brunswick Tribal Gaming

First Nation communities are involved in gaming in New Brunswick at multiple levels. The Grey Rock Entertainment Centre Inc. operates Grey Rock Casino on the Madawaska Maliseet First Nation under a service provider agreement with the NBLGC. More significantly, the Tobique First Nation (Neqotkuk) enacted the Tobique Gaming Act 2023 on October 13, 2023, establishing the Tobique Gaming Commission (TGC) as an independent online gaming regulatory authority based on the assertion of Indigenous self-governance rights under Section 35 of the Constitution Act, 1982. The TGC began issuing B2B licenses to international online gaming operators in March 2024, with its first license issued to a company under the SOFTSWISS brand. The TGC operates as a separate licensing jurisdiction and does not fall within the NBLGC's provincial monopoly framework; however, its legal status remains subject to potential future challenges or clarifications under Canadian federal and provincial law.
